Terms and conditions

You must accept these terms and conditions in order to use our website. If you do not agree to these terms, you must immediately stop using our website.

Last updated: 24 June 2025

1. About these terms

  1. These terms and conditions (“Terms”) govern your access to and use of GearStead, the website at www.gearstead.com and all associated AI tools (together “GearStead”, “we”, “us”, “our”).
  2. By creating an account or using any part of GearStead you confirm that you accept, and agree to comply with, these Terms. If you do not agree, do not use GearStead.
  3. We may update these Terms at any time. Changes take effect immediately once posted; continued use after that constitutes acceptance.

2. Registration and account security

  1. You must register before using any GearStead tool. Registration is limited to one account per natural person. Duplicate or shared accounts are prohibited.
  2. You are solely responsible for: (a) keeping your login credentials confidential; and (b) all activity that occurs under your account, whether authorised or not.
  3. You must tell us immediately at hello@gearstead.com if you suspect unauthorised access or any breach of security.

3. Daily free credits

  1. Each registered user receives ten (10) free credits each calendar day (00:00–23:59 UK time).
  2. Free credits do not roll over; unused credits are wiped at the end of the day.
  3. We may vary, suspend or withdraw the free‑credit offer at any time, with or without notice and for any or no reason.

4. Purchased credit bundles

  1. Additional credits may be bought in bundles shown on the checkout page.
  2. Payments are processed by our payment provider and will appear on your statement as THREADER.
  3. Bundles are non‑refundable and non‑transferable once any credit in the bundle has been used. Where the entire bundle remains unused you may request a full refund to the original payment method within 14 days of purchase; no partial refunds will be given under any circumstances. This clause does not affect your statutory rights.

5. Acceptable use and suspension

  1. You must not: (a)  use GearStead for any unlawful, harmful, fraudulent or obscene purpose; (b) attempt to gain unauthorised access to, interfere with or disrupt any part of GearStead, our servers or networks; or (c) misrepresent your identity, create multiple accounts, or otherwise abuse any promotional offer.
  2. We reserve the widest possible discretion to monitor activity. We may, at any time and without notice or explanation, suspend or terminate any account, remove credits (paid or free) or block access if we believe, suspect or simply decide that: (a) these Terms have been, might be or are likely to be breached; or (b) such action is desirable to protect GearStead, other users or our interests.
  3. If we close an account under clause 5.2, all unused credits are forfeited. No compensation is due.

6. AI content and service disclaimer

  1. GearStead’s tools generate outputs using third‑party AI models over which we have no direct control. The results may be inaccurate, incomplete, inappropriate, biased or fail to appear.
  2. You accept that: (a) AI outputs are inherently unpredictable; (b) you use them at your own risk; and (c) we will not refund credits (free or paid) or otherwise compensate you because the AI output was unsatisfactory.
  3. You must review all AI outputs carefully and, where necessary, obtain professional advice before relying on them.

7. Intellectual property

  1. We (and our licensors) own all intellectual‑property rights in GearStead and its underlying software, save for content lawfully provided by users.
  2. We grant you a non‑exclusive, revocable, non‑transferable licence to use GearStead solely for its intended purpose in accordance with these Terms.

8. Availability

  1. GearStead is provided “as is” and “as available”. We do not guarantee that the service will always be available, uninterrupted or error‑free.
  2. Maintenance, updates, hardware failures or force‑majeure events may make the service wholly or partly unavailable.

9. Limitation of liability

  1. Nothing in these Terms limits or excludes our liability for any liability that cannot be limited or excluded under the laws of England and Wales.
  2. Subject to clause 9.1 and to the fullest extent permitted by law: (a) we exclude all implied warranties, representations or other terms; (b) we will not be liable for any loss of profits, data, business, goodwill or any indirect or consequential loss; and (c) our total aggregate liability arising out of or relating to GearStead (whether in contract, tort or otherwise) will not exceed the greater of £50 or the total amount you paid us for credit bundles in the six months preceding the event giving rise to the claim.

10. Indemnity

You agree to indemnify and keep indemnified GearStead, its officers and employees against all claims, damages, losses, costs and expenses arising from your use of GearStead or breach of these Terms.

11. Severability

If any provision of these Terms is held unenforceable by a court, it will be severed and the remaining provisions will continue in full force.

12. Whole agreement

These Terms (together with our privacy policy) constitute the entire agreement between you and us regarding GearStead and supersede all prior understandings.

13. Governing law and jurisdiction

  1. These Terms and any dispute or claim (including non‑contractual disputes) are governed by the laws of England and Wales.
  2. The courts of England and Wales have exclusive jurisdiction, although we retain the right to bring proceedings against you in any other competent jurisdiction if we choose.
